Copyright and Music-Use Disclaimer

Swagg Brown is a digital DJ software platform operated by Swagg Brown Audio Labs. Swagg Brown provides tools that allow users to organize, analyze, mix, manipulate, perform, and locally record audio selected by the user.

Swagg Brown does not provide users with a commercial music catalog, does not sell or distribute copyrighted music, and does not grant users any license to copy, stream, perform, broadcast, remix, reproduce, distribute, publicly display, or otherwise use copyrighted music or other third-party content.

Local Music Files

Music selected from a user’s computer, local folder, external drive, or device remains on that user’s device.

Swagg Brown does not permanently upload or store those music files on Swagg Brown Audio Labs’ servers as part of the normal local-music workflow.

Swagg Brown may store limited organizational information and technical metadata, including track references, track names, artist and album information, BPM information, beat grids, cue points, loops, scratch markers, playlist organization, Record Crate organization, file fingerprints, user preferences, and application settings.

This metadata does not contain or replace the original music file.

Record Crates and Playlists

Record Crates and playlists are organizational tools. They store references and metadata only. They do not copy music files, move music files, upload music files, create permanent server copies, transfer ownership of music, or grant music licenses.

Removing a track from a Record Crate or playlist does not delete the original music file. Deleting a Record Crate or playlist does not delete music from the user’s device or connected cloud account.

Cloud Music Connections

Swagg Brown may allow users to connect supported storage providers such as Dropbox, Google Drive, Microsoft OneDrive, Apple iCloud-synchronized folders, local folders, and other supported storage services.

These connections allow users to access music stored in their own accounts or synchronized folders. Connecting a storage provider does not transfer ownership of music to Swagg Brown Audio Labs, prove that the user owns the music, prove that the user has permission to perform or distribute the music, or grant the user any additional copyright license.

Swagg Brown Audio Labs does not claim ownership of music selected from a user’s connected storage account.

Temporary access, streaming, decoding, or local caching may be required to play, analyze, scratch, or process a selected track. Temporary technical processing does not create a permanent music library on Swagg Brown servers and does not grant the user permission to use copyrighted content unlawfully.

Local Recordings

The Swagg Brown Record Mix feature is designed to record a user’s DJ performance inside the browser and save the completed recording locally to the user’s device.

Swagg Brown does not permanently receive, publish, distribute, sell, or store Record Mix audio on Brown Blanch Enterprises’ servers as part of the normal recording workflow.

The user is solely responsible for the content included in any recorded mix. Saving a recording locally does not grant permission to publish it, upload it, stream it, sell it, distribute it, broadcast it, share it publicly, or use it commercially. Users must obtain any licenses or permissions required for their intended use.

Instant DSP and Local Audio Processing

Instant DSP and similar browser-based features process audio locally on the user’s device where technically supported. Local processing does not transfer copyright ownership, create a music license, authorize public performance, authorize distribution, or authorize commercial exploitation. The user remains responsible for ensuring that the selected music may legally be processed and used.

Optional Third-Party Audio Processing

Certain optional features, including AI Stems or similar processing services, may require a user-selected audio file to be temporarily transmitted to an authorized third-party processing provider.

Before any such transmission, the user must provide express consent, confirm that they have the right to process the selected file, review the provider’s applicable terms and privacy policies, and understand temporary-file handling per the published Privacy Policy.

Temporary processing does not grant Swagg Brown Audio Labs or the user ownership of the underlying music. The user remains solely responsible for obtaining any required permissions.

User Responsibility

Users may use Swagg Brown only with audio and other content that they:

  • Created and own;
  • Are authorized or licensed to use;
  • Obtained from a lawful source with sufficient usage rights; or
  • Are otherwise legally permitted to use under applicable law.

Each user is solely responsible for determining whether the user’s intended activity requires a public-performance license, synchronization license, mechanical license, master-use license, reproduction license, broadcasting license, streaming license, venue license, platform license, royalty payments, or permission from an artist, label, publisher, composer, producer, or other rights holder.

Possessing a music file does not necessarily mean that the user has the right to publicly perform, reproduce, distribute, stream, remix, or commercially exploit that file. Using Swagg Brown does not make an otherwise unauthorized use lawful.

No Music License Provided

A Swagg Brown subscription or account provides a license to use the Swagg Brown software only. It does not provide a license to use any song, sound recording, musical composition, performance, album artwork, lyrics, video, photograph, sample, vocal recording, instrumental recording, or third-party content.

Prohibited Use

Users may not use Swagg Brown to:

  • Obtain or share pirated music;
  • Distribute unauthorized copies;
  • Bypass DRM or access-control technology;
  • Infringe copyrights or other rights;
  • Operate unlawful streaming or file-sharing services;
  • Assist others in copyright infringement; or
  • Evade licensing or royalty obligations.

Swagg Brown Audio Labs does not endorse, encourage, or knowingly facilitate copyright infringement.

Third-Party Services

Dropbox, Google Drive, Microsoft OneDrive, Apple iCloud, payment providers, AI-processing providers, music platforms, and other third-party services are governed by their own terms, privacy policies, and acceptable-use requirements. The ability to open, analyze, process, or play a file through Swagg Brown does not mean that the file is licensed for the user’s intended purpose.

Copyright Complaints

Copyright owners or their authorized agents who believe that content or activity associated with Swagg Brown infringes their rights may submit a copyright notice to:

Swagg Brown Audio Labs may investigate complaints, request additional information, preserve relevant records, restrict access to features, suspend or terminate accounts, remove associated references or metadata, disable temporary processing, and take other appropriate action when legally required or reasonably necessary.

Because Swagg Brown does not normally host permanent copies of users’ local music or locally recorded mixes, Swagg Brown Audio Labs may be unable to remove a file that exists only on a user’s own device or personal storage account. However, Swagg Brown Audio Labs may restrict or terminate the user’s access to Swagg Brown when appropriate.

Repeat Infringement

Swagg Brown Audio Labs may suspend or terminate users who repeatedly or seriously violate copyright, intellectual-property, or third-party rights.

User Representations

By using Swagg Brown, the user represents and warrants that the user:

  • Has the legal right to access the selected content;
  • Will not use Swagg Brown to infringe third-party rights;
  • Will obtain any licenses required for the intended activity;
  • Will comply with applicable laws; and
  • Will not misrepresent ownership or authorization.

Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless Swagg Brown Audio Labs, Swagg Brown, and their owners, employees, contractors, agents, and affiliates from claims, damages, losses, liabilities, costs, and expenses arising from or related to: your music or other content; your use of copyrighted material; your live performance; your recording; your broadcast or livestream; your distribution or publication; your violation of third-party rights; your violation of law; and your breach of the Terms of Service.

Users should consult a qualified attorney, licensing organization, venue, broadcaster, platform, publisher, record label, or applicable rights holder when uncertain about permissions or licensing requirements.

Policy Changes

Swagg Brown Audio Labs may update this policy from time to time. The current version will be posted on the Swagg Brown website with an updated effective date. Continued use of Swagg Brown after an update may be governed by the updated policy as permitted by applicable law.
